Terms of Service
Effective September 18, 2025
1. Agreement
These Terms govern your access to and use of the website and services provided by Soda Medic, LLC (“Company,” “we,” “us,” “our”). By requesting or receiving services, you agree to these Terms.
2. Services
We provide installation, repair, and maintenance for beverage and refrigeration equipment in Georgia and Alabama. Services are time‑and‑materials unless otherwise agreed in writing.
3. Pricing & Payment
- Current hourly rates are listed on the Pricing page (Standard $120/hr; Priority Same‑Day $150/hr; After‑Hours/Weekend $225/hr).
- Parts are billed at cost plus a 10% markup. Any trip or specialty fees will be disclosed if applicable.
- Payment is due upon receipt of invoice unless otherwise agreed in writing. We may suspend work for non‑payment.
4. Scheduling & Access
You are responsible for providing safe, timely access to the service location, equipment, and utilities. If our technician cannot access the site or equipment as scheduled, additional charges may apply for the visit.
5. Customer Responsibilities
- Provide accurate information about the issue and equipment.
- Ensure equipment is in sanitary and safe condition for service.
- Follow any post‑service instructions we provide.
6. Parts & Equipment
Replacement parts may be new or equivalent‑to‑new. Title to parts remains with us until payment is received in full.
7. Workmanship; Disclaimer
We perform services in a professional and workmanlike manner. EXCEPT AS EXPRESSLY SET OUT IN A WRITTEN WARRANTY SIGNED BY US, THE SERVICES AND PARTS ARE PROVIDED “AS IS” AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC WORK GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold us harmless from claims and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the services.
10. Cancellations
Please notify us as soon as possible if you need to cancel or reschedule. If a technician is already dispatched, a fee may apply.
11. Force Majeure
We are not responsible for delays or failures due to events beyond our reasonable control, including accidents, weather, supply constraints, or utility outages.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to conflict‑of‑laws rules. The exclusive venue for any dispute shall be state or federal courts located in Georgia, and you consent to their jurisdiction.
13. Changes
We may update these Terms from time to time. If we make material changes, we will update the “Effective” date above.
